ASIC has recently issued a statement regarding non-compliant fee consent forms due to the lack of account numbers in a client’s written consent to deduct ongoing advice fees. ASIC stated no action will be taken where fee consent forms that were used since 10 January 2025 did not include an account number, provided this is rectified by 5 September 2025. ASIC instructed advisers to obtain a new written fee consent that includes the period during which any fees were deducted under a non-compliant written consent. Additionally, super trustees are required to ensure their consent forms comply with the Corporations Act. Advisers should check their fee consent forms to determine whether they are affected.
